These Terms and Conditions govern your purchase of any products, services, coaching, memberships, retreats, events, digital programs or physical products offered by Prosper Performance Coaching ("we", "our", "us").

By purchasing from Prosper Performance Coaching, you acknowledge that you have read, understood and agree to these Terms.

1. About Us

Prosper Performance Coaching provides transformational coaching, consulting, leadership development, business services, digital education, live events, memberships, retreats and selected products.

2. Eligibility

By purchasing from us, you confirm that you:

Are at least 18 years of age;

Have the legal capacity to enter into a binding agreement; and

Will provide accurate and complete information when making your purchase.

3. Products and Services

Our offerings may include:

One-to-one coaching

Group coaching

Prosper Performance Coaching Programs

Workshops

Retreats

Live and online events

Memberships

Digital courses

Educational resources

Descriptions published on our website are provided in good faith but may be updated at any time.

4. Pricing

All prices are shown in US Dollars (USD) unless otherwise stated.

Prices may change without notice.

Applicable GST will be included where required by United States law.

5. Payment

Payment is required at the time of purchase unless a payment plan has been agreed.

Where payment plans are offered:

Payments must be made on their due dates;

Missed payments may result in suspension of access to services or products until payments are brought up to date.

Prosper Performance Coaching reserves the right to engage debt recovery services if payments remain outstanding.

6. Custom Programs and Services

Where customised coaching, consulting, business strategy, website development, branding, marketing or other bespoke services are provided:

Work will commence only after payment (or the first scheduled payment) has been received;

Additional work outside the agreed scope will be quoted separately;

Approved variations are non-refundable once work has commenced.

7. Refund Policy

Unless otherwise stated, Prosper Performance Coaching offers a 30-Day Satisfaction Guarantee on eligible products and programs.

Refund requests must be submitted in writing within thirty (30) days of purchase.

Refunds do not include:

Shipping costs;

Transaction fees;

Completed consultation fees;

Services already delivered;

Customised work;

Event deposits;

Travel expenses;

Digital products that have been substantially accessed or downloaded where permitted under United States Consumer Law.

Physical products must be returned in good condition before a refund is processed unless otherwise agreed.

Nothing in this policy excludes your rights under the United States Consumer Law.

8. United States Consumer Law

Our goods and services come with guarantees that cannot be excluded under the United States Consumer Law.

You are entitled to remedies for major failures and compensation for any reasonably foreseeable loss or damage where required by law.

Nothing in these Terms limits your rights under United States Consumer Law.

9. Coaching Disclaimer

Our services are educational and transformational in nature.

They are not medical, psychological, psychiatric, financial or legal advice.

Participation is voluntary.

You remain responsible for your own health and mental care decisions, financial decisions and personal actions.

10. Results Disclaimer

Individual results vary.

While many clients experience significant personal and professional transformation, Prosper Performance Coaching cannot guarantee specific financial, emotional, relationship or business outcomes.

Your success depends upon many factors outside our control, including your own commitment and implementation.

11. Intellectual Property

All material provided by Prosper Performance Coaching remains our intellectual property.

This includes:

Videos

Presentations

Music

Recordings

Coaching frameworks

Worksheets

Manuals

Digital resources

Trademarks

Logos

Written content

No material may be copied, distributed, reproduced, modified or commercially exploited without written permission.

12. Memberships

Memberships continue according to the selected billing cycle until cancelled.

Cancellation requests must be received before the next billing date.

No partial refunds are provided for unused portions of a billing period unless required by United States Consumer Law.

13. Events and Retreats

Event registrations are transferable only with our written approval.

If an event is cancelled by Prosper Performance Coaching, participants may receive either:

A full refund; or

A credit towards a future event.

Prosper Performance Coaching is not responsible for flights, accommodation or travel expenses booked independently.

14. Limitation of Liability

To the maximum extent permitted by law, Prosper Performance Coaching shall not be liable for indirect, incidental, special or consequential loss arising from the use of our products or services.

Where liability cannot legally be excluded, it is limited to the remedies available under United States Consumer Law.

15. Privacy

Your personal information is handled in accordance with our Privacy Policy.

By purchasing from us, you consent to the collection and use of your information as described in that policy.

16. Website Use

You agree not to:

Misuse the website;

Attempt unauthorised access to our systems;

Interfere with website functionality;

Upload malicious software;

Infringe intellectual property rights.

17. Force Majeure

Prosper Performance Coaching is not responsible for delays or failure to perform resulting from circumstances beyond our reasonable control, including natural disasters, internet outages, government restrictions or emergencies.

18. Governing Law

These Terms are governed by the laws of Louisiana, United States.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Louisiana.

19. Changes to These Terms

Prosper Performance Coaching may amend these Terms from time to time.

Updated versions will be published on our website and become effective immediately upon publication.
